The partnership is the most flexible of all commercial structures, but is also the source of much internecine grief. Unlike incorporations, no particular structure or even agreement has to be constructed to set up business in partnership. Just like its namesake relation, family or matrimonial 'partnership', few difficulties arise until or unless there is a breakdown in the relationship. But by then it is usually too late to do much about it.

So the name of the game is to prepare an agreement (i.e. partnership agreement or deed) before you start, which will, in particular, set out the rules you agree will govern termination of the relationship should this arise.

And if you have already started, it is not too late to agree the terms of a partnership deed if you do not have one now, whilst your partnership relations are in good order.
